As Ms Myers admitted the breach, the charge was found proved.

Penalty:

Ms Myers advised of riding commitments at Trentham on Saturday January 21st, therefore she is suspended from the close of racing on Saturday January 21st up to, and including, racing on Thursday January 26th. The affected race meetings are Trentham January 23rd, Hawkes Bay January 25th and Gore January 26th.

Charge:

Following the running of Race 4, an Information was lodged by Mr N Goodwin alleging a breach of Rule 638(1)(d), in that shortly after straightening, K Myers permitted her mount, STELLA BELLA, to shift out when not clear of GALWAY, which was hampered.

Facts:

Mr Goodwin used the available films to highlight the incident. He showed the race as the horses turned the corner for home, with Ms Myers back in the middle of the field trailing Mr Innes. At this stage, she was boxed in with GALWAY to her outside ridden by Mr Ormsby. Seeking clear racing room, Ms Myers angled her mount out when not clear of GALWAY, forcing that horse out wider.

Ms Myers explained that she was initially to the outside of Mr Innes with clear running room, but on the point of the turn, he angled outwards, which forced her to go wider in an effort to get past him. She said that she was not really aware that Mr Ormsby was coming up on her outside, there was no contact between the two horses, and GALWAY overreacted.

Submissions for Penalty:

Mr Goodwin said that Ms Myers had a very good record, with only one charge of careless riding in the last 12 months. This was in August while riding in Australia, where she incurred a 7 day suspension.

Mr Goodwin maintained that despite Ms Myers angling her mount out when not clear of GALWAY, Mr Ormsby had merely been hampered for two strides and did not have to check his mount. He placed the interference in the low range, and submitted that a suspension in the vicinity of three days was appropriate.

Ms Myers said that she possibly came out a little bit sharper than she intended, and that in her opinion, the incident was very minor.

Reasons for Penalty:

In coming to a decision on penalty, the committee took into account all of the submissions. We adopted as a starting point, a suspension of five days, with credit given for Ms Myer’s excellent record and her admission of the breach. In looking at the degree of carelessness, Ms Myers did not push or barge her way out of a tight position, and there was no contact between the two horses. GALWAY was moved wider on the track, but it went on to win the race, so any interference suffered did not appear to substantially affect its chances. For those reasons, we placed the degree of carelessness towards the low end. It was our opinion that an appropriate penalty was one of three days suspension.

When asked by the committee if she would be seeking rides at the Gore meeting on Thursday 26th, Ms Myers said she would be. She said that Ms Lisa Latta had told her that she would be sending some of her horses to that meeting.
