Facts:

Following the running of Race 3 (Inpro Group 3yo Maiden) Information No. A7664 was filed with the Judicial Committee. It alleged that Mr McNab failed to make the carded weight for ABSOLUTELY ME (55.5kg).

Rule 330(3)(c) provides:

A rider shall not fail to ride a horse at the weight at which it is handicapped to carry.

Mr McNab acknowledged that he understood the Rule and confirmed that he admitted the breach.

Submissions for Penalty:

Mr Goodwin said that Mr McNab had advised the Stipendiary Stewards prior to Race 1 that he could not ride ABSOLUTELY ME due to being 1kg over the horse’s carded weight (55.5kg). He advised the committee that Mr McNab had been fined five times during the past 12 months for being overweight. The record showed that the most recent on 7 May 2016, incurred a fine of $200. Mr Goodwin submitted that a fine of no less than $300 would be appropriate.

Mr McNab said that he had tried hard to shed the necessary weight, but had difficulty due to the lack of hot water with his shower and sauna issues. He said that since he has returned from a relatively lengthy suspension he has found it very difficult to keep his weight under control and it has proven to be a constant battle to maintain it at a consistent level. Mr McNab said that a fine of $300 would be a fair penalty.
