Alleging breach of Rule 869 (4)
Facts:
Following the running of Race 1, the Bayleys Real Estate Mobile Pace, an Information was filed by Stipendiary Steward Mrs K. R. Wiliams against Junior Horseman Mr T. M. Williams alleging a breach of Rule 869(4) in that he drove in a manner which caused interference.
The charge reads as follows.
“I the abovenamed informant allege that the abovenamed Defendant committed a breach of Rule 869(4) in that horseman T. Williams drove “Double Sharp” in a manner which caused interference to “Toby Dylan” when crossing to the lead after 200m of this event.”
Rule 869(4) reads as follows,
“(4) No horseman shall during any race do anything which interferes or is likely to interfere with his own horse and/or any other horse or its progress.”
Mr Williams is a Junior Horseman and he was assisted at this hearing by Open Horseman Mr J. R. Dunn. Mr Williams had indicated on the Information that this breach of the Rules was admitted, and he also agreed that he understood the charge and the Rule it was brought under.
Submissions for Decision:
Mrs Williams gave evidence and used video coverage to show that Mr Williams had crossed over too quickly when moving to the marker line, and that as a result “Toby Dylan” was checked and broke. Mr Williams had nothing to say about the facts of this matter.
Reasons for Decision:
As Mr Williams had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
Submissions for Penalty:
In relation to penalty Mrs Williams advised that Mr Williams had no relevant previous convictions, was a Junior Horseman, and had admitted the breach. It was submitted that a fine of between $250-00 and $350-00 should be imposed in this case.
Mr Williams had no submissions to make as to penalty.
We adjourned to consider the matter of an appropriate penalty.
Reasons for Penalty:
In considering an appropriate penalty we took into account that this breach was admitted, and also that Mr Williams had no previous relevant convictions under this Rule, and was a Junior Horseman. Taking all these matters into account, and penalties imposed in previous similar cases, we decided that an appropriate penalty in this case was a fine of $250-00.
