As the breach was admitted we find the charge proved.

Accordingly we impose a fine of $500.

Facts:

Following race 7 an information was filed pursuant to rule 614 (2).  Mr A Coles alleged that Mr A Smith, trainer of BLUE RANGER, presented his horse to race without the lead bag in place. 

Submissions for Decision:

Mr Coles explained to the committee that Mr Smith presented his horse at the plate inspection area prior to race 7.  At this point the assistant stipendiary steward, Mr G Stewart, discovered the lead bag was not in place.  Mr Smith when told of his ommission of the lead bag immediately took the horse back and resaddled with the lead bag in place.

Mr Smith, in admitting his mistake , said he normally saddled his horses on his own but on this occasion had another person to assist.  He was on one side of the horse and was unaware that the lead bag had been omitted.

Submissions for Penalty:

Mr Coles said Mr Smith had been fully cooperative with the stewards and this was his first charge regarding gear.  However the responsibilty to ensure horses were presented correctly to race were those of the trainer concerned.  Mr Coles submitted 2 previous charges under the same rule attracted fines of $500 which he believed was appropriate in this case. 

Mr Smith had nothing to say regarding penalty.

Reasons for Penalty:

The committee carefully considered all evidence and submissions.  It was explained to Mr Smith the serious repercussions that could arise from leaving a lead bag off when saddling up.  It was fortunate in this case it was discovered prior to the race.  The committee was satisfied there was no intention on Mr Smith's part to gain an advantage by leaving off the lead bag and it was an unfortunate mistake on his part.

It is most important in these charges, in particular, that consistency is maintained.
