The protest is dismissed and dividends and stakes are to be paid as the horses crossed the line.

Facts:

Mr Pitman, the trainer of the 4th placed horse HILL OF GOLD, alleged that JAGGARD or its rider, placed 3rd by the Judge caused interference to HILL OF GOLD. The interference allegedly occurred at the 350 metre mark.

Judges margins were: 1 1/4 lengths; nose; and a neck.

Submissions for Decision:

Mr Pitman demonstrated on 2 video angles that shortly after rounding the final bend JAGGARD, ridden by C Johnson, had moved off the fence and, in so doing, he alleged, the horse presented a gap for HILL OF GOLD. As HILL OF GOLD moved into the gap, the gap closed as JAGGARD rolled in and moved back to the fence. HILL OF GOLD was then required to come around the horses in front of it, and the horse finished on strongly for 4th. He emphasised it was an ever diminishing margin at the finish. Mr Pitman emphasised that in his view HILL OF GOLD was entitled to take the run on the inside of JAGGARD.

The rider of HILL OF GOLD, Ms Van der Werf, confirmed Mr Pitman’s submissions and also said that HILL OF GOLD had lost at least 2 lengths as a consequence of not being able to take the gap.

Mr Johnson stated that he had led into the straight and, if there was a gap, it was pretty marginal. In fact, he believed there was never room for HILL OF GOLD to progress on his inside. He said HILL OF GOLD would have had to have run with its legs under the rail.

Mr McGarry, the trainer of JAGGARD, said HILL OF GOLD had made up ground quickly on JAGGARD and that it was dangerous territory into which HILL OF GOLD was proceeding, as there was obviously no gap. He also pointed out the configuration of the running rail and that it was not straight at this point, which made the gap look bigger than it actually was.

Mr Davidson, stipendiary steward, was asked to comment on the videos and the submissions. He said it was for this Committee to determine if a run was there. He believed a gap may have been presented for a couple of strides but it was marginal.

Reasons for Decision:

The videos demonstrate that shortly after turning for home JAGGARD briefly rolled off the fence. A gap was thus presented for HILL OF GOLD, however that gap closed almost immediately. HILL OF GOLD had made ground up quickly on JAGGARD at this time but HILL OF GOLD was never fully in the gap when it closed as JAGGARD rolled back in.

We do not believe there was ever a run for HILL OF GOLD on the inside of JAGGARD. We thus find that JAGGARD did not cause interference to HILL OF GOLD.
