Meet Title:
Levin RC - 29 November 2019

Meet Chair:
NMcCutcheon

Meet Committee Member 1:
TUtikere

Race Date:
2019/11/29

Race Number:
R 4

Decision:

As the breach was admitted, it was deemed proved.

Penalty:

Ms Myers' Jockey’s Licence was suspended from the close of racing on 30 November up to the cessation of racing on 11 December 2019 (6 days).

Facts:

Following the running of Race 4 (Paul Ireland Digger Hire Premier) Information A11662 was filed with the Judicial Committee. It was alleged by the Informant that Ms R Myers allowed her mount BELLE PLAISIR to shift out in the home straight when not clear of HARBOURSIDE which was checked near the 200m.

Ms Myers said that she understood the Charge, Rule and confirmed that she admitted the breach.

Mr Goodwin indentified the riders and horses on the film replays and said that Ms Myers came out into Mr Waddell’s mount HARBOURSIDE when only one length clear, which resulted in Mr Waddell having to take evasive action.

Ms Myers said that her horse hung early in the race and then raced greenly and overreacted more than it should have. She said that she did let it shift too far.

Submissions for Penalty:

Mr Oatham produced Ms Myers' record which showed 3 breaches in the last 12 months, with the latest being in April when a 6-day Suspension was imposed.

Mr Oatham placed the carelessness on this occasion being a little below mid-range.

Ms Myers said that she would like any suspension of her licence to commence after 30 November.

Reasons for Penalty:

Considering Ms Myers is a very busy rider her record was considered to be a neutral factor. The Committee placed the carelessness demonstrated on this occasion to be below mid-range. Taking into account the JCA Penalty Guidelines, a 7 Riding-day Suspension was adopted as a starting point, with a discount of one day given for the admission of the breach.
