As the breach was admitted it was found to be proved by the Judicial Committee.

Penalty:

Mr Lammas’ Jockeys License was suspended from the close of racing on 7 January 2017 up to and including racing on 18 January 2017 (4 days).

Facts:

Following the running of Race 6 (2016/2017 Dunstan Feeds Stayers Championship Final), Information No. A8659 was filed with the Judicial Committee. It was alleged by Mr Oatham that near the 400m Mr Lammas the rider of EL FERNANDO allowed his mount to shift out when not sufficiently clear of QUINTESSENTIALLY which was checked.

Rule 638(1)(d) provides:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be (d) careless

Mr Lammas acknowledged that he understood the Rule and confirmed that he admitted the breach.

Mr Williamson showed all film replays and said that Mr Lammas allowed his mount to shift out near the 400m when not clear of QUINTESSENTIALLY which was forced across heels and checked.

Mr Lammas in response said he agreed that he did move out, that he had a couple of looks, thought that he was clear but obviously he was not and that it was an error of judgment on his part. He added that he was one length clear and only hampered the outside horse.

Submissions for Penalty:

Mr Oatham said that Mr Lammas had had three breaches of the Rule during the previous 12 months with the latest being on 12 October 2016 when a four-day suspension was imposed. He added that the record was a neutral factor and placed the carelessness slightly below mid-range.

Mr Lammas said that he had quite a clean record and that he does ride throughout the North Island. He added that he would like any suspension to start after racing on 7 January 2017.

Reasons for Penalty:

The mitigating factor is the admittance of the breach. The committee considered the careless riding to be below mid-range and that Mr Lammas’ record was average and deemed to be a neutral factor. The committee accepted that Mr Lammas does ride throughout the North Island.

In determining penalty the committee had regard for the fact that Mr Lammas’ suspension will include a Premier race meeting and also noted that the incident occurred in an $80,000 race.

After taking into account all of the above matters the committee believed that an appropriate term of suspension was one of 4 riding days.
