Penalty:

Miss Goldsbury you are suspended from race riding after racing on Thursday 27 October (at which you asked to be able to ride at) until the completion of racing on Tuesday 1 November, (2 CD days). These days are:

Manawatu 29 October

Otaki 1 November

Facts:

Following the running of race 6 at Woodville, THE TONY STEWART MAX TARR 1200, Miss Goldsbury admitted the charge that she used her whip in an unnecessary manner on her mount PINSONELLA when out of contention.

Rule 638 (B) (I) reads: A rider shall not strike a horse with a whip in a manner which is unnecessary.

Miss Goldsbury acknowledged she understood the rule.

Mr Goodwin showed the films of the incident and pointed out that Miss Goldsbury's mount was some distance from the major players in the run down the straight when she struck her mount when well out of contention.

Miss Goldsbury agreed the incident looked bad and that it was a lapse of judgement on her part.

Mr K Smith agreed and told the committee he and Mr N Harris had been talking at length to apprentices about unnecessary and excessive whip use. He hoped the message was getting through.

Submissions for Penalty:

Mr Goodwin confirmed that this was Miss Goldsbury's second breach of rule 638. The last was on 22 September at Otaki when she was fined $300. He believed the breach was at the lower end of the scale but did reiterate the stewards' determination to ensure breaches like this do not happen.

Miss Goldsbury and Mr Smith had no comment except to say jockeys are sometimes put under pressure by connections to get the best out of their mounts.

Reasons for Penalty:

In coming to its decision, the committee took into account the admittance of the breach and the fact that it was at the lower end of the scale. However, the incident did look bad on film and the committee was mindful that this was the second time in about a month that Miss Goldsbury had breached the whip rule. The committee expressed its view that the difference between unnecessary and excessive under rule 638 should not preclude the guidelines from being imposed. After all the whip rule had been breached for the second time by Miss Goldsbury.

The guidelines for a second breach indicate a period of suspension be imposed. From a starting point of three days the committee took into account the admittance and the belief the breach was at the lower end of the scale. A discount of one day was so accorded.
