As the breach was admitted we find the charge proved.

Penalty:

After taking all the facts into account we impose a fine of $225.

Facts:

Prior to race 4, the Tavistock Syndicate Owners 2 YO 1000, the informant Mr M Williamson alleged that Mr M McNab failed to make the contracted weight for STRADA CAVALLO.

Rule 330 (3) (c):  a rider shall not fail to ride a horse at the weight at which it is handicapped to carry.

Mr Williamson told the committee that Mr McNab came to the stewards earlier in the day telling them he would be unable to make the carded weight for his mount STRADA CAVALLO in race 4 and would be more than half a kilogram over.  Mr Williamson said the same applied to another of Mr McNab's mounts OCEANIA in race 6 but it was the stewards' practice to only bring one charge for the two offences.

Mr McNab said he had been sweating hard and thought he could do the weight.  He said he rides at 53.5 kgs in the summer but finds it harder in the winter to maintain that weight.

Submissions for Penalty:

Mr Williamson said Mr McNab had incurred 2 weight charges in the last 12 months with this one being his third in 4 months.  He said he would leave it to the committee to impose an appropriate penalty.

Reasons for Penalty:

The committee considered the explanations given by Mr McNab and Mr Williamson.  In mitigation Mr McNab has admitted the breach but as explained to him the committee is concerned this is his third breach of this rule in the last 4 months.  It told Mr McNab he had let down the connections of 2 horses at a late stage and that any breach of this rule in the near future would attract a much heavier penalty.  We referred to other penalties under this rule which showed $225 was the consistent penalty imposed.
