The breach is admitted and therefore the charge is proved.

Penalty:

This Committee imposes a fine of $500.00 on Mr Weatherley.

Facts:

Following the running of the DUNSTAN HORSEFEEDS 1600 an Information was lodged by Senior Stipendiary Steward Mr M Williamson against Rider Mr S Weatherley alleging that Mr Weatherley (the Rider of WATCH THIS SPACE) used his whip excessively prior to the 100 metres mark.

Rule 638(3)(b)(ii)  provides : A Rider shall not strike a horse with a whip or to an extent which is excessive.

NZTR issued Whip Guidelines on the 7th of October 2020 providing for a limitation on the use of the Whip to 5 strikes prior to the 100 metres mark. NZTR  then followed this up with revised Whip Penalties coming into force on the 9th day of December 2020.

Mr Weatherley was present at the Hearing and he acknowledged that he understood the Whip Guidelines and Penalties and he confirmed that he admitted the breach.

The incident was demonstrated to the Committee by Stipendiary Steward Ms V Algar using the available race films. She identified WATCH THIS SPACE and showed where Mr Weatherley used his whip 8 times prior to the 100 metres mark.

Mr Weatherley agreed with the number of strikes.

Submissions for Penalty:

Mr Williamson said that Mr Weatherley had one previous breach of this Rule on the 25th of November at Te Rapa and for that he received a 7 day suspension. He said that under the present Guidelines and as a result of the reset period this is Mr Weatherley's second charge and therefore it would attract a $500.00 fine.

He said that there were no aggravating nor mitigating features and accordingly the prescribed fine was appropriate.

Mr Weatherley said that he made a mistake and he needs to work on his use of the whip.

Reasons for Penalty:

The film  evidence is clear and the number of strikes is agreed. In terms of the latest Starting Point penalties the appropriate fine is one of $500.00.
