Mr. Gillies, you are suspended from race driving after the completion of racing this Friday the 11th of February 2011 until the completion of racing on Thursday the 24th of February 2011 (4 days).
Charge:
Alledged breach of rule 869 (3) (b)
Facts:
Horseman G. Gillies did not admit a breach of rule 869 (3) (b) in that as the driver of Gwynfromeartoear he drove carelessly when he caused interference to Supreme Christian (J. Abernethy) with approximately 450 metres to run.
Mr. Taumanu using the available films pointed out the incident which happened on the point of the bend and just after. Mr. Gillies was improving 3 wide and after pulling the ear plugs on the point of the bend, moved sharply inwards causing interference to Mr. Abernethy resulting in two other horses travelling behind also being affected. He informed the committee the movement was sharp and he did make contact with the outside leg of Mr. Abernethy’s horse.
Submissions for Decision:
Mr. Gillies called as a witness Mr. J. Abernethy, the driver of the affected horse, who had little to say only confirming that movement inwards caused his horse to break. He felt that Mr. Gillies did attempt to straighten.
Mr. Taumanu reiterated his strong belief that the inwards movement which may have resulted from the pulling of the ear plugs on the point of the bend was the contributing factor to Mr. Abernethy’s horse breaking.
Reasons for Decision:
The committee, having revisited the available films on a number of occasions, clearly believe that the sharp inward movement was the sole cause of the horse driven by Mr. Abernethy breaking which in turn caused problems for two horses travelling behind. While an attempt was made by Mr. Gillies to straighten, it was too little too late.
Submissions for Penalty:
Mr. Taumanu asked for a period of suspension. He felt the incident was in the mid to upper range and three horses were affected. He believed it was an error of judgment by Mr. Gillies.
Mr. Gillies confirmed he had a drive this Friday night but concurred a period of suspension was probably inevitable.

Mr. Gillies, this committee is of the opinion that this charge is best answered by way of a period of suspension. We concur with Mr. Taumanu it was an error of judgement on your part and not only Mr. Abernethy’s drive but also two others were affected.
