Mr Allison alleged that in Race 8, the WINTON TOP PUB MOBILE PACE, Mr Walkinshaw (THEO BOSS) struck the sulky wheel of CHERS BETTOR BABE (Mr Williamson) causing the tyre to come adrift.

Mr Allison demonstrated the incident on the video and described the respondent’s carelessness as being at the lower end of the scale, although the consequence of his actions was a relegation. He produced the respondent’s record, which evidenced a previous breach on 21 April 2013 when the fine was $250. Mr Allison submitted a fine at the lower end was appropriate.
