As Mr Dewe has admitted the breach, it is found to be proved.

Penalty:

Mr Dewe was fined the sum of $500 and the likely consequences of any further breach at this level was emphasised to him.

Facts:

Mr Renault, Stipendiary Steward, alleged that Mr Dewe used his whip excessively on his drive ERROL FINN inside the final 400 metres in race 8, the FORBURY PARK SPORTS BAR JUNIOR MOBILE PACE.

Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Renault demonstrated on the videos that the respondent, who was two wide at the head of the field as they turned for home used his whip at least 20 times in the last 400 metres. For part of the time it was whilst both his hands were on the reins but he crossed the reins into one hand about halfway down the straight and the strikes then became free hand. It was estimated these were about nine in number.

Ms Barclay assisted Mr Dewe. She said he was inexperienced and had just come back to driving.

Mr Dewe acknowledged he was in error and said he was used to being able to use rein and whip together, provided it was not continuous. He said he would need to adjust his use of the whip in order to comply with the current guidelines.

Submissions for Penalty:

The penalty is determined by a sliding scale. Where the number of strikes is over 17 and it is a first offence, it is $500. The count for Mr Dewe is 20. There are a couple of late taps which, if counted, would take the number above 20. Mr Dewe has had 11 drives this season, nine last, and 61 the season before. Mr Dewe has only recently come back to race driving and, whilst he said he had not been counting, he was aware he was getting close to the permitted number of strikes, and that was why he had gone back to using whip and rein.

Reasons for Penalty:

This is Mr Dewe’s first breach of this rule since the regulations came into force on 30 November 2017.. The Use of the Whip Regulations provide for a fine of $500. After discussion of the possibility of a lesser fine coupled with a suspension, it was determined that a fine was appropriate.
