The protest was upheld and TANG was declared a non-starter.

Facts:

The rule reads, 213(1)(j):

A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:- if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.

At the conclusion of Race 3 The To Race 2 Pacers Mobile Pace a protest was lodged (Information) 2413 by Stipendiary Steward Mr S P Renault to determine whether TANG (10) Mr T Williams was denied a fair start.

Submissions for Decision:

Stipendiary Steward Mr S P Renault used several video clips that highlighted the start of race 3.

Mr Renault stated that in his opinion TANG had started at least three lengths behind its official starting position which was number three on the second line.

Mr Renault also stated that VILLAGE CLUB (C Barron) which started in position two on the second line had broken and moved out slightly, denying TANG the opportunity to move into its correct starting position.

Mr Williams (TANG) stated that he did not get the opportunity to put his horse into the correct starting position , because of the breaking horse.

Mr Williams was also of the opinion that there was not quite enough room for his horse as the horses left the mobile gate, with his horse at least three lengths behind the starting position he was entitled to be in.

Mr T Popham (Starter) stated that Mr Williams showed no real urgency to get into his starting position and that he believed there was sufficient room for TANG to start in its correct position.

Reasons for Decision:

The video evidence was clear that TANG started at least three lengths behind its official starting position, and this was a result of VILLAGE CLUB breaking and moving out slightly, hindering TANG from starting in its correct position.
