.As the breach was admitted we find the charge proved.

Penalty:

Accordingly after taking all the above factors into account we impose a suspension on Mr Collett from riding in races which is to start after racing on 19 February and conclude after racing on 2 March 2011 (6 ridng days).  In addition we impose a fine of $500.

Facts:

The informant Mr M Williamson alleged that near the 200 metres Mr J Collett permitted his mount JETSET LAD to shift in causing both BANCHEE and O'REILLY'S PRIZE to check.

Submissions for Decision:

Mr George demonstrated the video films which showed JETSET LAD ridden by Mr J Collett, racing in a 4 wide position at the 200 metre mark.  Mr George then pointed out to the committee Mr Collett commencing an inward movement to gain a better run on the inside of ICE PIN.  Mr George submitted that Mr Collett was not the required distance clear of BANCHEE when he moved into her line.  He said this caused BANCHEE to be checked which also resulted in O'REILLY'S PRIZE who was on BANCHEE'S inside to receive a check.  Mr George said Mr Collett did not leave enough room for those 2 horses on his inside, positions that they were entitled to.  He said Mr Collett should have stopped riding his mount rather than going for an inside run.

Mr J Collet said that ICE PIN had shifted out when in front of him and he changed his ground inwards as a result.

Mr R Collett confirmed what Mr J Collett had said and believed that the outward movement of ICE PIN contributed to the incident.

Submissions for Penalty:

Mr Williamson said Mr Collett had only incurred 1 suspension for careless riding in the last 12 months.  He asked the committee to consider the level of interference to BANCHEE and O'REILLY'S PRIZE and also the status of the race.  He submitted a suspension of 5 - 7 days and a $500 fine would be appropriate.

Mr J Collett told the committee he did not have any firm commitments after 19 February 2011.

Reasons for Penalty:

The committee carefully considered all the evidence and submissions.  Mitigating factors are Mr Collett's excellent riding record and his admission of the breach.  However these are outweighed by the following aggravating factors:

1  The interference suffered by BANCHEE and O'REILLY'S PRIZE at a crucial stage of the race when they were both in challenging positions.

2  The status of the race being a Group 2 for a stake of $85,000.

3  Mr Collett's level of carelessness which the committee finds to be in the midrange.
