As Mr Calder admitted the breach the Committee found the charge proved.

Accordingly, Mr Calder had his license to ride in races suspended for a period to commence after racing on 4 August and conclude after racing on 19 August 2018.
Facts:
Following the running of race 3, John Letts Guest Speaker 17th August 1100 , an Information was filed pursuant to Rule 638(1)(d). The Informant, Mr Williamson, alleged that Mr Calder allowed VON TRAPP to shift out between the 150 metres and the 50 metres causing interference to TINY TERROR.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Calder said that he understood the Rule and confirmed that he admitted the breach.
Mr Jones demonstrated the incident using the available video footage. He identified that Mr Calder allowed his mount to shift out 6 to 7 horse widths in the final straight. As a result this caused interference to TINY TERROR which resulted in VON TRAPP being relegated from 1st placing. He added that Mr Calder continued to ride his mount forward when it was shifting out and this dictated the running line of TINY TERROR.
Mr Calder said that VON TRAPP was a green horse and he believed that his mount shied at something in the home straight. He said that he should have stopped riding and straightened his mount when it was shifting out. He added that he turned VON TRAPP’S head inwards in an attempt to correct the outward shift.
Submissions for Penalty:
Mr Williamson said that Mr Calder had a clear record since returning to ride in New Zealand. Mr Williamson was unable to produce Mr Calder’s Macau race riding record and said the level of interference was low range. He said that Mr Calder failed to stop riding his mount forward which forced TINY TERROR out wider on the track. He submitted that the Committee needed to consider that the interference resulted in a change of placings.
Mr Calder said that he had been charged only once for careless riding during the last 4 years in Macau. He submitted that any proposed suspension could start immediately.

The Committee carefully considered all the evidence and submissions presented.
During our deliberations the Committee was able to access Mr Calder’s riding record from the Macau Racing Club website. This confirmed that Mr Calder had an excellent record under this Rule, his last charge was in March 2016. The NZTR records show that Mr Calder has had 74 rides since his return from Macau.
The Committee observed that Mr Calder continued to ride his mount forward with the whip when it was clearly shifting out. Mr Calder’s mount was only a neck to half a length clear of TINY TERROR at all times when he dictated that runner out approximately 7 horse widths over a distance of more than 100 metres. Mr Calder failed to take reasonable steps to avoid causing interference to TINY TERROR. The Committee deemed the level of carelessness displayed by Mr Calder was midrange.
The Committee adopted 8 national riding days as the starting point which is in accordance with the JCA Penalty Guide.
The aggravating factor was that as a consequence of Mr Calder’s actions VON TRAPP was relegated from 1st placing. This warranted a 1 day uplift in penalty.
The mitigating factors were Mr Calder’s admission of the breach and his excellent record. For these combined factors Mr Calder was afforded a 2 day reduction in penalty.
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 national riding days.
