Penalty:
Miss Johnsons licence to ride in races is suspended for a period of 7 days commencing after racing on 3 January 2020 and concluding after racing on 14 January 2020.
In affixing penalty dates we did not include 4 and 5 January 2020 as rider declarations for those meetings had closed.
Facts:
This charge arises from the running of race 5 the Dunstan Feeds Stayers Championship Final. Chief Stipendiary Steward, Mr Oatham filed an Information pursuant to Rule 638(1)(d) alleging that Miss Johnson (LINCOLN KING) permitted her mount to shift in near the 250 metres when not sufficiently clear of SWORDS DRAWN which was forced inwards across the heels of STEVEN JAMES.
Miss Johnson acknowledged she understood the Rule and confirmed her admission of the breach.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Using all available video footage Senior Stipendiary Steward, Mr Williamson demonstrated the incident that gave rise to this charge and identified all horses and riders concerned, namely: LINCOLN KING (D Johnson), SWORDS DRAWN (O Bosson) and STEVEN JAMES (M McNab). He told the Committee that approaching the 250 metre mark LINCOLN KING was racing outside of STEVEN JAMES with SWORDS DRAWN behind that runner. He said that Miss Johnson allowed her mount to shift in when not clear and forced SWORDS DRAWN in across the heels of STEVEN JAMES. He added that Miss Johnson shifted in for 3 to 4 strides and she should have relieved the pressure on SWORDS DRAWN earlier.
In response Miss Johnson said that she had very little to say and the incident appeared to look worse on the films when her mount touched SWORDS DRAWN.
Submissions for Penalty:
Mr Oatham produced Miss Johnson's riding record which indicated she has a good record in relation to the careless riding rule, having ridden in 243 races in the past 12 months without a breach. He added that during this period Miss Johnson did not ride for some time due to injuries.
Mr Oatham said Stewards assessed the level of carelessness as being above mid-range and it is of significance that the race carried a stake of $100,000. He added that the affected runner, SWORDS DRAWN was entitled to a clear run and its chances were extinguished. He also said that in assessing penalty Miss Johnson should to be given credit for her admission of the breach and her good record.
In response, Miss Johnson advised she had confirmed engagements up until 3 January 2020 and any proposed suspension could commence immediately after the conclusion of racing on that date.
In terms of any proposed penalty Miss Johnson offered no submissions.
Reasons for Penalty:
After considering the submissions the Committee reviewed the race film and determined Miss Johnson’s carelessness to be mid-range and adopted an 8-day starting point. This is in conformity with the Penalty Guide for Judicial Committees which recommends an 8 national day starting point for mid-range end carelessness.
On reviewing the available films, the Committee noted that approaching the 250-metre mark in the home straight there was a clear gap for SWORDS DRAWN to take between LINCOLN KING and STEVEN JAMES. As rider Mr Bosson angled his mount into the gap, Miss Johnson shifted in 1 horse width, made contact with SWORDS DRAWN and continued to shift in. At the point of contact LINCOLN KING was no more than a ½ length clear. The Committee also observed that SWORDS DRAWN had to be heavily restrained after being denied its rightful running line and shut out of the gap. SWORDS DRAWN then became awkwardly placed on the heels of STEVEN JAMES.
Aggravating factors are that this breach occurred in a race with stakemoney of $100,000 although we note it was not a Listed or Group race. Accordingly the Committee applied 1 day penalty uplift.
The mitigating factors we considered included Miss Johnson’s admission of the breach and her good riding record under this Rule, albeit she was injured and did not ride for a period of time during the past 12 months. For those combined factors we afforded her a 2 day reduction from our starting point.
After taking into account all the above factors the Committee considered that an appropriate suspension was 7 days.
