Facts:
Following race 2 an information was filed pursuant to rule 340. Mr George alleged that Mr H Bowman had weighed out in an unapproved vest.
Submissions for Decision:
Mr George told the committee that it was noticed after weighing out for race 2, that Mr Bowman was wearing a vest which was not permissable in Australia or New Zealand. Mr George conceded that the vest had not been modified but was simply an unapproved one.
Mr Bowman said he did not use this type of vest for weight reasons but for one of comfort. He submitted he did not realise they were not acceptable in New Zealand.

Mr George said this was Mr Bowman's first charge under this rule and submitted a fine of $300 would be appropriate.
Mr Bowman asked the committee for leniency as he had a clear record under this rule for 13 years.

The strong mitigating factors are Mr Bowman's admission of the breach and his clear record under this rule. However, as pointed out to Mr Bowman a rider of his experience in both countries should be aware of the safety vest regulations.
