The protest is upheld and LLEYTON H is disqualified from the race.  The amended result is now:

1st 9 - Perigo
2nd 3 – Lord Brylin
3rd 12 – La Femme Dargent
4th 8 - Illuminati
5th 10 – Me An Kel
6th 5 – Jimmys Dream

It was ordered that dividends and stakes be paid in accordance with the amended result.

 

Facts:

Following the running of Race 8 an Information Instigating a Protest was lodged by Stipendiary Steward Mr NM Ydgren against the fourth placing of horse number 13 LLEYTON H on the grounds of breaking with approximately 100 metres to race and continuing in that break over the finishing line.
Mr D Balle, Co-Trainer of LLEYTON H endorsed the Information with the words “I do not contest the protest”.

Rule 870(3) provides:
"Any horse which breaks from its gait shall promptly regain its proper gait”.
The Breaking Horse Regulations Part B provide:
"Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of rule 870(3) in that it has failed to promptly regain its proper gait.”.

Submissions for Decision:

Mr Ydgren demonstrated the incident by use of the video films. The films showed quite clearly LLEYTON H breaking at about 100 metres from the finish and continuing on in a break across the finishing line.  

Reasons for Decision:

The protest is not contested and clearly the provisions of Rule 870(3) and The Breaking Horse Regulations apply.
