Facts:

Mr Ydgren, stipendiary steward, alleged that DOLLAR SIGN (C Harrison), which finished 2nd, shifted wider on the track in the home straight crowding the running of DASHWOOD REBEL (K Barron).

The Judge’s placings were:

Submissions for Decision:

Mr Ydgren first called Mr Barron to give evidence. He stated that shortly after the field turned for home a gap presented itself between DOLLAR SIGN and TIPSY GAMBLER. He said he was committed to this gap but from then on he was hampered for room and he touched Mr Hay’s cart and broke. He said he believed the horse on his inner, which was DOLLAR SIGN, had drifted wider on the track closing the gap. He said initially Mr Hay was trying to keep him out of the gap but when Mr Hay saw that Mr Barron had established himself in the gap he (Mr Hay) moved wider on track. He said after viewing the videos he was certain the gap had closed because of outwards movement by Mr Harrison and not inwards movement from Mr Hay.

Mr Ydgren asked Mr Ray to demonstrate the incident on the videos. He highlighted that DOLLAR SIGN had drifted outwards after DASHWOOD REBEL had gone for a run that was available outside DOLLAR SIGN. He said the consequence was interference to DASHWOOD REBEL with that horse breaking.

Mr Harrison said that there was a general movement outwards and that there had been a touching between his cart and a leg of Mr Barron’s horse. He said DASHWOOD REBEL broke some time after this (he thought 2 or 3 lengths later) and that the contact between his cart and DASHWOOD REBEL had not caused that horse to break. He alleged that DASHWOOD REBEL had been going rough prior to this incident and that the fact DASHWOOD REBEL broke was not down to DOLLAR SIGN. Mr Harrison acknowledged, however, that he “may have drifted out.”

Reasons for Decision:

We are satisfied that there was initially a run for DASHWOOD REBEL between DOLLAR SIGN and TIPSY GAMBLER and the reason the gap closed was that DOLLAR SIGN was drifting out on the track as it was under pressure in the run home. Mr Harrison has said the leading horse (LOOSE CANNON) drifted out also. We are satisfied that any movement by that horse had no impact upon DOLLAR SIGN as LOOSE CANNON as there was always at least 1 ½ to 2 horse widths between the 2 horses. We accept Mr Harrison’s allegation that there was contact between DASHWOOD REBEL and DOLLAR SIGN and that DASHWOOD REBEL broke some time later. But this was because Mr Barron had checked DASHWOOD REBEL and was moving outwards and away from DOLLAR SIGN that had gradually drifted out and closed the gap. DASHWOOD REBEL was crowded for racing room and that horse was dictated outwards onto the sulky of TIPSY GAMBLER. Mr Barron's evidence is clear that his horse broke due to contact with Mr Hay.

We are satisfied the chances and progress of DASHWOOD REBEL were affected as the only reason that the horse ultimately broke was because Mr Barron was taking evasive action as the gap into which he was entitled to progress and into which he was progressing closed because of the gradual outwards movement of DOLLAR SIGN.
