Mr Cations admitted the charge. The charge is proved.

Mr Cations is fined $200 and reminded of his obligations under the Rules in regards to the use of the whip.

Charge:

Following the running of Race # 8 the SPEIGHTS MOBILE PACE Stipendiary Steward Mr N Ydgren lodged an Information alleging Mr M Cations (JAYCEES BELLE) used his whip excessively -Rule 869 (2) (a) – over the final stages while driving JAYCEES BELLE.

Facts:

With the use of the videos Mr Ydgren stated Mr Cations had used his whip approx. 23 times in the home straight. He said Stewards charged horsemen when they used the whip in excess of 20 times.

Mr Cations stated he was not hitting the horse hard at any stage. He was using the whip to encourage the mare and stop the mare from knocking off in the home straight.

Submissions for Penalty:

Mr Ydgren said Mr Cations had a clear record in respect of the whip charge over the past 12 months. He said the use of the whip was at the lower end of the scale. Mr Cations had a total of 9 drives to this point of the season and 39 in his career. He was seeking a fine of $200.

Mr Cations stated he had one horse in work and intended racing the mare in the next few weeks. He would accept a fine as opposed to a suspension.

Reasons for Penalty:

After hearing the submissions on penalty the committee took into account the following: Mr Cation’s early admission of the charge, his good record and that the use of the whip was at the lower end of the scale. The committee believed a fine was appropriate.
