GREY STOKE was disqualified from its 5th placing.

3rd - SUPERFAST NINJA

Authority was given for stakesmoney to be paid in accordance with the amended placing.

Facts:

This is a protest instigated after the running of Race 3, the Dunstan Horse Feeds Handicap Trot 2200m.

Mr Muirhead alleged that 5th placed horse, GREY STOKE broke near the 700 metres and galloped in excess of 150 metres before finishing in 5th place.

The owner/trainer Miss L Edwards endorsed the Information to the effect that:

   (a) She did not wish to contest the protest, and

   (b) She did not wish to be present at the hearing.

Rule 870(3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait.'

The Breaking Horses Regulations (a) say that 'Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to regain its gait.'

Submissions for Decision:

Using the films Mr Muirhead identified the horse GREY STOKE as it  neared the 700 metres. The horse then went off stride and continued to gallop until the finishing post.

Mr Muirhead said that the horse was therefore in breach of the Rules and Regulations.

Reasons for Decision:

The Committee were satisfied from the films that GREY STOKE had gone into a gallop and had continued in a gallop for at least 150 metres in breach of the Rules and Regulations.
