As Mr Goindasamy admitted the breach the Committee found the charge proved.
Penalty:
The Committee granted a 7-day deferment to Mr Goindasamy’s suspension pursuant to Rule 1106(2).
Accordingly, Mr Goindasamy had his license to ride in races suspended for a period to commence after racing on 21 March and conclude after racing on 28 March 2020.
Facts:
Following the running of race 5, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Jones, alleged that Mr Goindasamy allowed AILEEN GRACE to shift in when not clear of ARRAIGNMENT who had to be checked near the 50 metres.
Mr Goindasamy said that he understood the Rule and confirmed his admission of the breach.
Mr N Harris assisted Mr Goindasamy at the hearing.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Coles demonstrated the incident using the available video footage. He identified that Mr Goindasamy allowed his mount to shift in when not clear of ARRAIGNMENT which was checked near the 50 metres. He added that Mr Goindasamy made an error of judgement.
Mr Goindasamy stated he used his whip on one more occasion than he should have.
Mr Harris said that Mr Goindasamy should have stopped riding and straightened his mount when it shifted in. He added that the rider of ARRAIGNMENT over reacted when checked.
Submissions for Penalty:
Mr Jones said that Mr Goindasamy had 3 previous breaches under this Rule in the last 12 months. He said this was a significant improvement from the previous 12 months. He submitted the level of carelessness was low to mid-range and a penalty in line with that would be appropriate.
Mr Goindasamy advised that any proposed suspension could start after racing on 21 March. He added that he was trying to improve his careless riding record.
Mr Harris had nothing to add.

The Committee considered all the evidence and submissions presented.
When reviewing the video footage, the Committee found that Mr Goindasamy permitted his mount to shift in when 1 length clear of ARRAIGNMENT. As a result, that runner was crowded and checked near the 50 metres. The Committee deemed the level of carelessness displayed by Mr Goindasamy was low range.
The JCA Penalty Guide starting point for low range carelessness is 6 national riding days which was adopted.
The mitigating factor was Mr Goindasamy’s admission of the breach. For this he was afforded a 1-day reduction in penalty.
We deemed Mr Goindasamy’s record to be a neutral factor.
After taking into account all the above factors the Committee considered that an appropriate suspension was 5 national riding days.
