Mr Cox admitted the breach, which we thus find proved.

Penalty:

We fine Mr Cox the sum of $200 and remind him of his professional obligations.

Facts:

Mr Allison alleged that Mr Cox drove carelessly in race 10 in that he shifted ground outwards when insufficiently clear of NEVER EYRE (M Williamson) causing that horse to check near the 500 metres mark.

Mr Allison demonstrated on the videos that the respondent was second last on the inner with some 500 metres to run. Mr Cox pulled out to follow MIKE MCKAID (B Barclay). NEVER EYRE (M Williamson) was also improving to follow MIKE MCKAID and TUSCALOOSA (T McMillan), which was making ground from the rear, was to the outside of Mr Williamson. Unfortunately for Mr Cox, Mr McMillan was ahead of Mr Williamson who thus had nowhere to go when Mr Cox moved wider on the track, as he was unable to ease Mr McMillan wider. Mr Williamson had to take hold of NEVER EYRE and went back to the rear of the field.

Mr Cox explained that down the back straight NEVER EYRE was moving out a touch. He saw half a gap when MIKE MCKAID came out, as he had thought Mr Williamson would have improved to follow that horse but had not. He said when he came out he knew Mr McMillan was on the outside of Mr Williamson but thought Mr Williamson had an advantage on him. He recognised after viewing the videos that he clearly did not.

Submissions for Penalty:

Mr Allison described the breach as low end. He produced the respondent’s record. Mr Cox’s last breach of this rule was in May last year. He has had 195 drives this season and 422 the previous. Mr Allison submitted a fine at the lower end was appropriate.

Mr Cox accepted Mr Allison’s submission.

Reasons for Penalty:

We agree with Mr Allison that the breach is low end. The incident occurred when the respective horses were towards the rear of the field. It was simply a misjudgment by Mr Cox. The resulting interference was not high although Mr Williamson lost the opportunity to improve his horse at a significant stage of the race, there being only some 500 metres to race. Mr Williamson was squeezed for room, lost his position and had to settle back at the rear of the field.

Mr Cox is a busy driver and his record can fairly be described as very good. He has admitted the breach.
