Facts:

Mrs J Young-Grant was charged with failing to drive her horse out to the finish r 868 (3) following the running of Race 7. The Stewards alleged Mrs Young-Grant stopped driving Perfect Cut out to the finish line when it had a reasonable chance of finishing in fourth placing. Mrs Young Grant admitted the breach and appeared at the hearing.

Mr McIntyre, with the aid of the video replays, said Perfect Cut was in fourth position about 50 metres from the finish. Up to that point Mrs Young-Grant had been urging Perfect Cut forward. However, approximately 40 metres from the finish Mrs Young-Grant stopped driving her horse out and Perfect Cut was beaten a long neck, finishing in fifth placing. He said the Stewards believed that had Mrs Young-Grant driven Perfect Cut out to the finish there was a reasonable chance of the horse finishing in fourth placing.

Mrs Young-Grant stated it was debateable whether Perfect Cut would have finished in fourth placing. She said she drove Perfect Cut all the time and in her opinion he was doing his best and had nothing left.

Ms Haley stated Mrs Young-Grant was a busy driver and had had 170 drives this season. She had an excellent record and no previous breach of this Rule. The Stewards believed Perfect Cut had a reasonable chance of finishing in a better position and they were seeking a $400 fine or 8 drives suspension.

Mrs Young-Grant said she had admitted the breach and had an excellent record. She preferred a fine as opposed to a suspension.
