Facts:
Mr Kennedy rang Mr McLaughlin at 8 am today to say that he had forgotten to scratch CAVORTS from race 1. Mr Kennedy indicated he was in Timaru and thus had insufficient time to return to the stable at Riccarton and get CAVORTS by the start time of the 1st race.
There were horses balloted out in race 1 and thus a horse had been denied a start due to the defendant’s actions.

Mr McLaughlin stated that Mr Kennedy had been called to Blenheim at short notice due to a family illness.
He produced the defendant’s record, which was clear under this rule. He submitted a fine in the range of $200 to $300 was appropriate.
Reasons for Penalty:
We accept the defendant has simply forgotten to scratch CAVORTS. His record is excellent. Balancing the mitigating factor of a family illness against the aggravating factor that another horse was denied a start, we believe a penalty at the bottom of the range identified by Mr McLaughlin is appropriate.
