After taking all the above into account and under the provisons of Rule 1106 (2) we impose a suspension on Mrs Satherley from riding in races which is to start after racing on 23 May and conclude after racing on 30 May 2012 (4 days).

Facts:
Following race 5 an information was filed pursuant to rule 638(1)(d). The informant Mr Oatham alleged that at the 200 metres Mrs L Satherley riding SOPHIE'S GEM allowed her mount to shift out into the line of MANDERLEY (Mr J Waddell) which had to check.
Submissions for Decision:
Mr Williamson demonstrated the video films which clearly showed SOPHIE'S GEM moving out approximately 3 to 4 horse widths approaching the 200 metres. He submitted Mrs Satherley was only 3/4 to a length ahead of MANDERLEY when she allowed her mount to move out. This outward movement caused Mr J Waddell, rider of MANDERLEY, having to take a hold and check off heels. Mr Williamson added that SOPHIE'S GEM was not corrected by Mrs Satherley.
Mrs Satherley in admitting the charge said her mount was rolling out under pressure but she did not hear any calling from Mr Waddell.

Mr Oatham said Mrs Satherley had a clear record in the last 12 months. He stated the result of her outward movement today could well have cost MANDERLEY the chance to finish in the first three placegetters. He submitted the breach was in the midrange of carelessness.
Mrs Satherley said she had commitments up to and including 23 May 2012 and she did not ride in the South Island.

The committee carefully considered all evidence and submissions. Mitigating factors are Mrs Satherley's admission of the breach and her outstanding record. However in this charge today she was not the required distance clear when moving out resulting in a significant check to MANDERLEY. The committee finds the breach to be in the mid range of carelessness.
