As Mr Singh admitted the breach the charge was found to be proved by the Committee.

Penalty:

Mr Singh’s Apprentice Jockey’s License was suspended from the close of racing on 2 December 2017 up to and including all racing on 15 December 2017 (9 days).

Facts:

Following the running of Race 7 (Harris Contracting McVerry Crawford Handicap), Information No.A8793 was filed with the Judicial Committee. It was alleged by the Informant that Mr Singh allowed his mount to shift ground when not sufficiently clear of CONSTANT BARRAGE approaching the 400m.

Rule 638(1)(d) provides:
   A rider shall not ride a horse in a manner which the Judicial Committee considers to be:
   (d) careless;

Mr Singh acknowledged that he understood the Rule, the charge and confirmed to the Committee that he admitted the breach.

Mr McIntyre showed all relevant film replays and identified both horses. He said that CLASS ABOVE (M Singh) was racing one-off the fence with CONSTANT BARRAGE (S O’Malley) half a length back and to its inside. He said that in the approach to the 500m SIOUX (T Johnson) who was ahead of CLASS ABOVE began to weaken and that Mr Singh shifted his mount in for a run when not clear of CONSTANT BARRAGE. He said that as a result of the shift CONSTANT BARRAGE was checked.

Mr Singh for his part said that his horse was clipping heels thus being the reason he shifted in.

Mr Singh declined to show where this occurred on the film replays when invited to do so by the Chairman.

Mr Wallace did not make any comment.

Submissions for Penalty:

Mr Goodwin said that Mr Singh’s action in shifting in was excessive and that he had shifted his problems onto someone else and as a consequence CONSTANT BARRAGE ran out of room. He placed the carelessness above mid-range and submitted that a term of suspension be imposed.

Mr Singh advised the Committee that he had riding engagements on 2 December and asked that any suspension imposed commence after that date.

Reasons for Penalty:

The Committee observed that near the 600m CONSTANT BARRAGE was racing adjacent to the running rail with CLASS ABOVE to its outside and approximately half a length in advance. As they approached the 500m SIOUX who had been racing ahead and in front of CLASS ABOVE was under pressure and struggling to hold its position. Mr Singh was then observed to shift his mount in into the rightful running line of CONSTANT BARRAGE who received a relatively severe check. Mr Singh’s submission that he was clipping heels was rejected by the Committee due to the lack of any corroborative evidence. In assessing the degree of carelessness exhibited by Mr Singh, the Committee was satisfied that it was above mid-range.

The JCA starting point for mid-range carelessness is 8 days. As the carelessness was deemed to be above mid-range the starting point was lifted to 10 days suspension. Taking into account Mr Singh’s record (3 prior breaches in the last 12 months) and his admission of the breach a discount of 1 day was given.
