As Ms Myers had admitted the breach, the charge was found proved.

Penalty:

We therefore determined that Ms Myers’ licence to ride be suspended from the conclusion of racing on 28 June 2018 up to and including racing on 6 July 2018.

Facts:

Following the running of Race 6, the Greenwood Amberley Cup, an Information was filed by Stipendiary Steward, Mr J McLaughlin, against Ms R Myers alleging that she “allowed her mount NASHVILLE to shift inwards when not sufficiently clear of STOKERS ROCK (T Moseley) who was crowded and checked near the 150 metres.”

Rule 638(1)(d) reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Ms Myers had indicated on the Information that this breach of the rules was admitted and she confirmed this at the hearing. Ms Myers also agreed that she understood the charge and the rule it was brought under.

Mr McLaughlin, gave evidence and used video coverage along with Mr Davidson, to show approaching the 150 metres Ms Myers riding her mount towards the lead of the race. As she was passing Mr Moseley her horse shifted inwards and forced Mr Moseley to steer clear of NASHVILLE'S hind quarters. Mr Davidson said as this happened Ms Myers tried to straighten her mount but the interference had unfolded.

Ms Myers said the incident was clear to see and added she was perhaps one stride too late in correcting her mount.

Submissions for Penalty:

Mr McLaughlin said Ms Myers had one breach of this rule in the past 12 months which was on 28 April 2018 at Hawkes Bay where she incurred a 5-day suspension. He said Stewards saw this as a very good record. He added they assessed this breach as low range and would leave it to the Committee to determine penalty.

Ms Myers made no submissions on penalty but informed the Committee that she had confirmed rides at the Waverley Racing Club on June 28 and asked for a deferment of any suspension until after that date.

Reasons for Penalty:

In determining penalty, the Committee had regard to the Penalty Guide starting points for breaches of the careless riding rule. The Committee adopted a 6-day starting point as we agreed the level of carelessness was low.

The aggravating factor was the race was the feature race of the day and Ms Myers went on to win the race.

Mitigating factors are her frank admission and her record which this Committee considers very good.

Considering all the evidence and submissions and applying the aggravating and mitigating factors the Committee determined that a 5-day suspension is an appropriate penalty in this case.

Ms Myers' application for deferment is granted.
