Mr Johnson admitted the breach which we thus find proved.
Penalty:
In fixing penalty Mr Johnson was given credit for his early admittance of the breach. Mr Johnson was suspended from the conclusion of racing on Tuesday 1st November 2011 up to and including racing on Tuesday 8th November 2011 (Four National riding days).
Charge:
Mr Davidson alleged that Mr C Johnson (Hernandez) rode carelessly over the concluding stages of the race causing interference to L Robinson (Zoe Brook) and crowding to K Williams (Seasprite).
Facts:
Mr Davidson asked Stipendiary Steward Mr A Rae to demonstrate on the videos Mr Johnsons riding over the concluding stages. Mr Rae highlighted that in his opinion Mr Johnson allowing his mount to shift out over the concluding stages when not clear of Zoe Brook (L Robinson) which had to be restrained and lose running to which it was entitled, then continued to shift out contributing to crowding of Seasprite (K Williams) which was checked.
Mr Rae stated that Mr Johnson had not taken any corrective action and when he did it was too late as he was not sufficiently clear of either Zoe Brook or Seasprite.
Mr Johnson (Hernandez) stated that his horse was racing a little greenly and although he had tried to take some action he agreed that it was too little too late.
Submissions for Penalty:
Mr Davidson produced Mr Johnsons record stating that it had been relatively good over the past twelve moths. Mr Johnson had occurred a double suspension at the Otago Racing Club Meeting held on the 26/12/2010 and a further suspension under the same rule at the Canterbury Jockey Club Meeting on the 17/9/2011 where he was suspended for four National days riding.
Mr Davidson stated that Mr Johnson had admitted the breach at the earliest possible time and that he should be given some credit for this when fixing penalty. He also stated that he believed the degree of carelessness on this occasion was mid range.
Mr Davidson confirmed that Mr Johnson was a very busy sought after National rider.
Mr Johnson stated that he had commitments at the Poverty Bay Meeting on the 4/11/2011 and the 6/11/2011 and also commitments on the 5/11/2011 at the Canterbury Jockey Clubs Premier Meeting. These commitments were confirmed by Mr Johnson's agent and with no objection from the Stipendiary Stewards.
Reasons for Penalty:
The Committee was clearly satisfied that a breach of the rule had occurred and that Mr Johnson had made a simple error of judgement by not taking corrective action quickly enough allowing his horse Hernandez to move outwards onto Zoe Brook and then onto Seasprite. Both of these horses clearly were interfered with and although not affecting their chances of improving their stake bearing placings, the interference was significant.
