For the reasons above the committee is satisfied that the chances of BLOOMING HELL were not materially prejudiced through a partially slow gate. Therefore we declare BLOOMING HELL to be a starter in Race 4 as listed.

Facts:

Following race 4 an information was filed by Mrs L Satherley under rule 632 requesting a ruling as to whether BLOOMING HELL was denied a fair start.

Submissions for Decision:

Mrs Satherley demonstrated the video films pointing out to the committee where she started from gate 4.  She said that her gate came back on her after opening which prevented her from being near the lead which was where she wished to be.  Mrs Satherley submitted that she was denied a fair start through no fault of her own.

Mr Sherwin stated BLOOMING HELL had lost momentum through the gate coming back and had she started cleanly she would have been near the front.

Mr Harrison, the starter, said in his opinion, the gate has not switched back but the suction didn't hold properly causing it to rebound slightly.  He said he did not believe BLOOMING HELL was denied a fair start.

Mr Neal said it was clear the gate had rebounded causing BLOOMING HELL to lose a length or so.  He said it was over to the committee to decide if this was detrimental to its chances.

Reasons for Decision:

The committee considered all evidence and reviewed the films several times. We are satisfied the gate has opened in unison with the others and while 1 side has rebounded slightly it is noticeable that BLOOMING HELL was in 3rd position after 2 or 3 strides.
