As Mr Turner admitted the breach we found the charge proved.

Penalty:

Accordingly Mr Turner is suspended from riding from the conclusion of racing on Tuesday November 4th up to and including racing on Sunday November 9th. The days included in this suspension (only Northern dates were considered) are:

7/11/14 Rotorua
8/11/14 Waikato
9/11/14 Hastings

Facts:

Following the running of Race 3, The Nigel ‘Sharkie’ Clark Memorial Maiden, an Information was lodged by Mr R Neal alleging a breach of Rule 638(1) (d) in that Dylan Turner angled his mount out near the 300 metres making heavy contact and unbalancing HONEY QUEEN (V Johnston) when not clear.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

At the beginning of the hearing Mr Turner acknowledged that he understood the nature of the rule and confirmed he admitted the breach.

Mr Neal explained to the Committee that there were two components to the incident but only the second led to the charge of careless riding.  Just after the point of the turn Mr Turner improved onto the heels of HONEY QUEEN, an action the Stewards were not concerned about but when Mr Turner found himself held up for a run he angled to the inside of HONEY QUEEN looking for a way through. At this stage Mr Turner pushed through making heavy contact with HONEY QUEEN turning her inwards.

Mr Turner said that he did come back off the heels of HONEY QUEEN but his horse was racing very greenly. It was only the second time it had raced in blinkers and its greenness had not helped the situation.

Submissions for Penalty:

Mr Neal said there was a fine line between careless riding and competitive riding and on this occasion Mr Turner had crossed that line. Once the initial bump had occurred Mr Turner should have pulled off but he kept going and bumped heavily again. Mr Neal conceded that J’WALKE was racing greenly and may have overreacted therefore the stewards placed the degree of carelessness at the low end.

Mr Neal informed the committee that Mr Turner had just one prior careless riding charge on October 11 this year.

Mr Turner told us that J’WALKE had been racing greenly throughout the race and this had had some bearing on the incident.

Mr Clements, who was assisting Mr Turner, asked the committee to consider that any period of suspension would make it difficult for Mr Turner to maintain his weight.

Reasons for Penalty:

In coming to a decision on penalty the committee took into account all of the submissions presented. We adopted a starting point of five days suspension and applied mitigating and aggravating factors accordingly. For Mr Tuner’s admission of the breach and his good riding record we have discounted one day. The degree of carelessness we placed at mid-range. Mr Turner forced a run through on the inside of HONEY QUEEN making heavy contact on 2-3 occasions causing that horse to become unbalanced. Although his horse may have been racing ungenerously Mr Turner did have the opportunity to take corrective action after the first point of contact but he did not do so.
Balancing up all of these factors it was our opinion that a four day suspension was an appropriate penalty.
