The Protest is upheld and SISTER COURAGE is disqualified from the race.

The amended placings are now : 1st  No 3 CEROCK

                                                5th  No 9 GOLD ELITE

It is ordered that dividends and stakes be paid in accordance with the amended placings.

Facts:

An Information was lodged by Stipendiary Steward Mr JM Muirhead against the 2nd placing of SISTER COURAGE (Driver Mr J Abernethy) on the grounds of breaking prior to the 50 metre mark and continuing in a gallop up to and past the Winning Post.

Rule 870(4) provides: "that any horse that breaks from its gait during a race shall be promptly returned to its gait."

The Breaking Horse Regulations (part B) provide: "any horse which breaks from its gait in the final 200 metres of any race and continues on in a break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(4) in that it has failed to promptly regain its gait."

Mr Abernethy advised this Committee that he represented the connections of SISTER COURAGE and he endorsed the Information with the words " I do not contest the Protest".

Submissions for Decision:

Mr Muirhead demonstrated the incident by use of the video films. He showed SISTER COURAGE leading in the run home and it broke from its gait with approximately 70 metres to run and continued in a break up to and past the winning post.

Reasons for Decision:

The Protest is not contested and the video films clearly show SISTER COURAGE breaking in the home straight and galloping for approximately 70 metres.
