As the breach was admitted, we find the charge proved.

Penalty:

After taking all of the above into account, and having particular regard to similar past weight offences and Mr Ormsby’s record under this rule, we impose a fine of $400.

Facts:

Following race 2, an information was filed pursuant to rule 330 (3) (c). Mr Coles alleged that Mr C Ormsby, rider of PACIFIC CHOICE, failed to make the contracted weight.

Submissions for Decision:

Mr Coles explained to the committee. that Mr Ormsby informed them prior to race 2, that he could not make the carded weight of 55.5 kgs. Mr Ormsby, in admitting the breach, said that he was confident he could make today’s book weight of 55.5kgs, but could not seem to lose weight despite being in the sauna and spa this morning. He said that it was his 3rd day riding in a row which may have been a reason.

Submissions for Penalty:

Mr Coles submitted this was Mr Ormsby’s fifth weight related charge this year. He said that on the last occasion on 22 October, he was fined $200 and submitted a fine of no less than $300 on today’s charge, would be appropriate.

Reasons for Penalty:

The committee considered all evidence and submissions. It was explained to Mr Ormsby, in the strongest terms, the need for him to be certain he could make his book weights before accepting mounts. It was pointed out to him, the inconvenience caused to connections and punters alike, when he could not fulfill engagements on the race day when he was the published rider.
