The protest was upheld and SOUTHERN ALPS was disqualified from the race. Consequent upon the disqualification, the amended placings for the race are as follows:

1st  5 Enghien
2nd 2 Custodian
3rd 4 Muscles Galore
4th 1 Ruthless Kayla

It was ordered that dividends and stake monies be paid in accordance with that amended result.

Facts:

Following the running of Race 1, Lone Star Riccarton Sires Stakes 2YO Mobile Trot Prelude, an information instigating a protest was filed by Stipendiary Steward, Mr S W Wallis, against SOUTHERN ALPS (R D Holmes), placed 4th by the judge, on the grounds that it “broke in excess of 150 metres when in a break [sic] over the early stages”.

Mr Holmes had endorsed the information and signed “I do not contest disqualification”. Mr Wallis confirmed that the connections of SOUTHERN ALPS did not wish to attend the hearing of the information.

The judge’s placings were as follows:

Rule 870 provides as follows:

(3) Any horse which breaks from its gait shall promptly regain its proper gait.

The Breaking Horses Regulation provides as follows:

For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:

(a) Any horse which breaks from its gait either at the start or during the running of any race and continues on in the break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:

(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or

(ii) disqualify it from the race under Rule 1003 (2).

Submissions for Decision:

Stipendiary Steward, Mr S W Wallis, showed video replays of the start of the 2000 metres mobile start event for 2-year-old trotters. He pointed out SOUTHERN ALPS, driven by Mr Holmes, which had drawn barrier position 3 in the 5-horse field. He then pointed out SOUTHERN ALPS go into a break, free of interference, approximately 20 metres after the start and continue in a gallop for a considerable distance – Mr Wallis estimated 210 metres. Mr Wallis sought disqualification of SOUTHERN ALPS.

Reasons for Decision:

The Committee was clearly satisfied, from the video evidence, that SOUTHERN ALPS had galloped at the start of the race, free of interference, and had continued on in a gallop for a distance well in excess of 150 metres. It was, therefore, in breach of Rule 870 (3) in that it had failed to promptly regain its proper gait and was in breach of the Breaking Horses Regulation. The Committee also noted that the protest was not contested by Mr Holmes.
