The Committee rules that SPIDER LILY (8) is declared to be a non-starter.

Facts:

Following the running of Race 10, Recreation Hotel Rating 65, an information was filed by Stipendiary Steward, Mr M R Davidson, requesting a ruling “as to whether SPIDER LILY (D A T Hirini) was denied a fair start”.

Miss Hirini was present at the hearing.

Rule 632 provides as follows:

(1) If, in the opinion of the Judicial Committee, a horse which does not finish in the first three placings was prevented from taking an effective part in a Race owing to the mechanical failure of the starting stalls, or is denied a fair start and such occurrence materially prejudiced the chances of that horse (but not where the horse is slow away by its own accord), the Judicial Committee may declare such horse to be a non-starter.

Mr Davidson said that, on reviewing the video footage of the start of Race 10, it was quite noticeable that two horses were very slow to begin. Stewards had spoken to both riders, he said. Miss Hirini said that the head of her horse was in the stall next door when the start was effected and was denied an opportunity to leave its gate. The horse which had drawn the barrier outside Miss Hirini, and which was also very slow away, was GOLDEN VALKYRIE (R Mudhoo). Mr Mudhoo had told Stewards that his mount was just very slow and had not been affected by Miss Hirini’s mount, Mr Davidson said.

Mr Davidson had Manager of Stewards, Mr N G McIntyre, point out the two runners on a head-on video replay. He pointed out SPIDER LILY (drawn 8), prior to the start, “shuffle over” into the partition between its gate and the gate of GOLDEN VALKYRIE (drawn 9) and, as the gates opened, SPIDER LILY had no chance to leave the gate on terms with the field, he said. That runner lost “many lengths”, Mr Davidson said, and this was clear from the side-on video replay of the start which was shown.

Stewards were not blaming the starter, although Miss Hirini had said that she was yelling.

Mr Davidson said that, although the horse had been misbehaving in the stalls, he submitted that, when the horse has put its head in the next stall, it cannot take an effective part in the race.

Miss Hirini said that she believed that her mount had been denied a fair start. It had all happened very quickly, she said. She had expected the mare to run “a nice race”, but she had lost too much ground that she had to make up. She added that it was fortunate that SPIDER LILY had not jumped immediately the gates opened as it could then have ended “quite badly”. 

Reasons for Decision:

The Committee is satisfied that SPIDER LILY was denied a fair start in the race. It was an unusual situation (both Mr Davidson and Miss Hirini agreed), that the horse had got its head over into the next stall occupied by GOLDEN VALKYRIE prior the start and, despite Miss Hirini calling to the starter, the gates had opened while its head was still in that position. Arguably, the horse was “slow away by its own accord” but the Committee does not find that this was the case, since the horse had put itself in that position clearly prior to the start.

The Committee is further satisfied that the chances of SPIDER LILY were materially prejudiced as a result. Having lost very many lengths at the start, perhaps as many as ten, the chances of the horse were virtually extinguished. At no stage did it regain contact with the field and beat only two of the eleven runners home.
