As the breach was admitted we find the charge proved.

Penalty:

Accordingly we impose a suspension on Mr Arumugan which will commence after racing on 12th March and conclude after racing on the 24th March 2011(5 riding days).

Charge:

Mr George alleged that near the 1000 metres Mr Arumugan permitted his mount PRINCESS ROAD to shift in making contact with the running rail.

Facts:

Mr George demonstrated the video films which showed PRINCESS ROAD was slow to begin from barrier 9. The head on film clearly showed Mr Arumugan direct his mount inwards at the 1000 metres making contact with the running rail.  Mr George had concerns that the horse could have received an injury from the incident.  A post race veterinary examination revealed no abnormalities.

Mr Clarken said Mr Arumugan steered his mount inward too sharply running into the first bend. This resulted in PRINCESS ROAD contacting the running rail.

Submissions for Penalty:

Mr George produced Mr Arumugan's record which showed two careless riding charges in the last 12 months. He said the carelessness was in the mid to high range and a suspension was the appropriate penalty.

Mr Arumugan said he had no commitments in the next seven days. He told the committee he only rides in the North Island.

Mr Clarken when asked had nothing to say.

Reasons for Penalty:

The committee carefully considered all evidence and submissions presented. Mitigating factors are his admission of the breach and his good record. However the aggravating factor was that Mr Arumugan made an error of judgement sending his horse on an angle too acute making contact with the running rail. The committee told Mr Arumugan he needed to exercise more care when shifting ground.
