As Mr Johnson admittedthe breach we found the charge proved.

Penalty:

Mr Johnson is suspended from the close of racing on Friday December 28nd up to and including racing on Tuesday January 1st Race days in this period are:

Charge:

Following the running of Race 8, an Information was lodged by Mr R Neal alleging a breach of Rule 638(1) (d) in that C Johnson (ARIETTA) allowed his mount to shift in shortly after the start tightening JACK’S POINT, THAT’SOUREXCUSE and HELL YEAH.

Facts:

Mr Johnson had drawn barrier eight in a fourteen horse field over 1200 meters. Mr Goodwin showed the head-on film of the incident which occurred soon after the start of the race when Mr Johnson was seeking a run closer to the running rail. Mr Johnson could be seen looking to his inside as he moved across but he was not the required distance clear of Mr Waddell when he did so causing JACK’S POINT to be checked. As a result of the check to that runner two other horses closer to the rail were tightened up.

Submissions for Penalty:

Mr Neal produced Mr Johnson’s riding record which showed one careless riding charge in the previous 12 months. This was a 3 day suspension imposed at Otago on the 6th November. Mr Neal said Mr Johnson was a busy rider who rides predominantly throughout the Central Districts and South Island although recently he has ridden at Ellerslie and Counties. He classified the degree of carelessness as slightly above mid range due to the number of horses affected.

Mr Johnson advised the committee of riding engagements on Boxing Day at Otago and at Timaru on Friday December 28th.

Reasons for Penalty:

The committee took into account all of the submissions and adopted as a starting point, a period of five days suspension. We assessed the degree of carelessness to be in the mid range with one horse receiving a check and the other two suffering some degree of tightening. We took into account Mr Johnson’s early admission of the breach and his excellent riding record giving him credit for this and reducing the penalty to a four day suspension. We were satisfied, by the evidence produced, that Mr Johnson accepts rides throughout the country.
