Facts:
Following the running of Race # 1 the LONE STAR CAFE & BAR TROT Stipendiary Steward Mr S Renault lodged a protest against the fourth placed horse COOL SON (R Swain). The Information alleged that "COOL SON broke in the run home around the 50 metre mark."
Submissions for Decision:
Mr Renault stated that approx. 50m from the finish COOL SON broke when racing between GENTLE GEORGIA (outer) and SPEEDY SUCCESS (inner). The horse continued in a break to the finish line and was officially placed fourth by the judge. He used both head-on and side-on videos to show the position of COOL SON and in particular where the initial break occurred. However, he stated that both videos were inconclusive as to whether COOL SON broke prior to the 50m mark or about the 50m mark.
Mr Swain stated his horse was improving in the home straight and started to trot roughly just prior to the 50m mark. In his view the horse had broken on the 50m mark and not before.
Reasons for Decision:
The Committee, after viewing the videos and hearing the evidence of both parties, found the video evidence inconclusive as to the point where COOL SON initially broke. The evidence given by Mr Renault also raised doubts as to the exact breaking point of COOL SON.
