Facts:
Follwing the running of Race 1, the MITOQ BEST DRESSED AT THE OAKS MARCH 2 MBL TROT 1700m, Mr Mulcay submitted an Information instigating a protest against the 3rd placing of the horse KRATOS. Mr Mulcay alleged that the horse broke in excess of 150 metres in the early stages of the race.
The Information was noted by Mr J Dickie, trainer of KRATOS to the effect that:
(a) He admitted a breach of that Rule, and that
(b) He did not wish to be present at the hearing.
Rule 870(3) provides that 'Any horse which breaks from its gait shall promptly regain its proper gait'.
The Breaking Horses Regulations provide:
(a) Any horse which breaks from its gait at the start or during the running of any race and continues on in a break for a distance of 150 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.
Submissions for Decision:
Using the available films Mr Mulcay identified the horse KRATOS shortly after the start of the race. The horse was in second place when it went off stride into a gallop. The horse continued on in a gallop for approximately 180 metres. Mr Mulcay submitted that the horse was therefore in breach of the Rule and Regulations and therefore should be disqualified from the race.
Reasons for Decision:
The Committee viewed the film and confirmed that the horse KRATOS had gone off stride and galloped - without regaining its gait at any time - for at least 180 metres. It was therefore in breach of the Rule and relevant Regulation.
