Facts:
Following the running of Race 10, the FIRST MEETING HERE NEXT SEASON 22 SEPTEMBER MOBILE PACE, an information was filed by Stipendiary Steward, Mr Quirk, alleging that Mr Ferguson, the driver of I’MALLABOUTTHEBASE, used his whip on more occasions than is permitted in clause (b) of the use of the whip regulations.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.
The Use of the Whip Regulations provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Quirk, Stipendiary Steward, demonstrated on the race films that the respondent used his whip 11 times in the home straight. I’MALLABOUTTHEBASE finished in 2nd position. These strikes were mainly freehand and the respondent was only over 10 because there were 3 quick-fire strikes near the winning post.
Mr Ferguson admitted the breach and indicated on the information that he did not wish to be present at the hearing.

Mr Quirk said Mr Ferguson was a busy driver. He had had 319 drives last season and 250 this season prior to today. His record was clear over the past 12 months. He submitted the $200 starting point in the JCA penalty guidelines was the appropriate penalty.
Reasons for Penalty:
The Committee is satisfied that Mr Ferguson used his whip 11 times inside the final 400 metres. The breach is thus within the low range, which is 11 to 13 strikes. Mr Ferguson’s record is excellent, with his having no previous breach of this rule.
