The committee believes that had Landlord not suffered the interference by Itsanobraina, Landlord would have finished ahead of Itsanobraina. Using our discretion we relegate Itsanobraina (1) behind Landlord (9) and therefore the final placing’s are:

1st Forbidden (10)

2nd Landlord (9)

3rd Itsanobraina (1)

4th Karina Rock (11)

5th Here’s De Consul (14)

The committee order dividends are paid accordingly.

Facts:

Following the running of Race One A Sharrock filed an information alleging a breach of Rule 642 (1) in that horse (1) Itsanobraina placed first by the Judge, interfered with the chances of horse (9) Landlord, placed third by the Judge after interference in the final straight.

Judge's placings were:

1st Itsanobraina (1)

2nd Forbidden (10)

3rd Landlord (9)

Official margins were ½ length and ½ head.

Submissions for Decision:

Mr Sharrock has said the winning horse has moved 3 horse widths out which has caused the whole concertina effect behind it and has stopped his horse, which has lost momentum, drifted 1and ½ to 2 lengths off the winner and with the margins being ½ length and ½ head at the finish, his horse was finishing very strongly and was denied any chance to win the race. O Bosson had nothing further to add.

L Allpress said with the margins at the line her horse was just too good and the 3rd horse had every opportunity to go past her mount in the straight.

F Auret stated Mr Hennessey’s horse has bumped Mr Sharrock’s horse inside his horse.Yes Itsanobraina has run out a bit and their horse has also been nudged in behind.

Mr Neal stated in his interpretation for the stewards, it is clear after straightening, L Allpress’s mount Itsanobraina has shifted out under hard riding. Mr Bosson is in trouble and has to restrain his mount off her heels, loses momentum then regathers his horse, takes a few strides to gather its momentum, moves to the outside of L Allpress and finishes resolutely over the final stages.

You have heard L Allpress state she was holding the other horse at the line. The interference suffered by O Bosson has not been insignificant at a critical point of the race.

The margin at the finish is for the committee to determine whether O Bosson’s chances were affected in finishing ahead of L Allpress.

Reasons for Decision:

The committee carefully considered all the evidence and have viewed the films at length. The interference to Landlord was significant and was initiated by Itsanobraina moving out across the rightful line of running entitled to Landlord. There was severe tightening and Landlord was hampered for approximately 10 strides at a critical stage of the race then ran on very strongly. Landlord has lost at least 2 lengths and with the final margins of ½ length and ½ head.
