Following race six an information was lodged alleging that Mr Du Plessis the rider of Captain Cruising, used his whip in an excessive manner prior to the 200 metres.
Rule 638 (3) (b)
(3) A rider shall not: (b) strike a horse with a whip in a manner or to an extent which is unnecessary, or excessive or improper.
The rule was read and confirmed.
Facts:
Mr Neale using the film identified Mr Du Plessis where he was leading the field into the home straight, used his whip approximately nine or ten times prior to the 200 metres. The steward’s component of this rule is excessive.
Mr Du Plessis stated his horse was rather lazy and did not realise the incident was as bad as shown on the video.

Mr Neale confirmed an excellent riding record of Mr Du Plessis and asked that consideration be given in relation to the number of his rides.
This may have been an error of judgement and the steward’s submission is this offence is deemed at the lower end of the scale and seeks a penalty in the range of two hundred dollars.
Mr Du Plessis asked the committee to consider the fact he is not an over zealous whip user and would support a penalty at the lower end.
