Facts:

Following the running of race 1, the TOP LINE FENCING LTD HANDICAP TROT, the Stewards lodged a Protest Information alleging a breach of Rule 870 (4) (a) in that “ILLUSTRIOUS QUEEN broke in excess of 50 metres over the concluding stages”.

Rule 870 (4) (a) reads:

Any horse which breaks from its gait in any race and:-

which fails to promptly regain its proper gait may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board be placed by the Judicial Committee immediately after any other horse in respect of which an advantage may have been gained.

Mr Allison was seeking the disqualification of ILLUSTRIOUS QUEEN from its fourth placing.

The official placings were:

1st - (5) Abraham Jones

2nd - (17) I’ldoitmyway

3rd - (10) Stylish Dude

4th - (16) Illustrious Queen

5th - (12) Spotlight The Valley

Submissions for Decision:

Mr Allison, with the use of the side-on video, stated ILLUSTRIOUS QUEEN led the field from the start until well into the home straight. About the 160m mark ILLUSTRIOUS QUEEN broke from her gait and continued on in a break until the finish line. ILLUSTRIOUS QUEEN was placed fourth by the judge at the line. He sought disqualification under the Rules.

Mr McKay accepted the evidence as presented by the Stewards and did not wish to contest the Protest.

Reasons for Decision:

The video evidence is very clear that ILLUSTRIOUS QUEEN galloped in excess of the allowable 50m over the final 200m.
