As Miss Smyth admitted the breach we find the charge proved.
Penalty:
We grant Miss Smyth’s request to seek a deferment to her suspension as per Rule 1106(2).
Accordingly, we impose a suspension on Miss Smyth which will commence after racing on March 8 and conclude after racing on March 13 (4 North Island days).
The penalty did not include any South Island meetings as Miss Smyth confirmed that she did not intend riding there.
Facts:
Following the running of race 1, Lindauer Mile, an Information was filed pursuant to Rule 638 (1) (d). The Informant, Mr Oatham, alleged that Miss Smyth angled her mount DRAGONKEEPER outwards when not the required distance clear of SECRETS ONLY which was checked near the 250 metres.
Miss Smyth acknowledged that she understood the nature of the charge, the Rule and confirmed her admission of the breach. Miss Smyth was assisted at the hearing by her employer Mr N Tiley.
Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Oatham demonstrated on the head on video film Miss Smyth was looking for clear racing room and she angled her mount out. In doing so Miss Smyth was not clear of SECRETS ONLY which resulted in its rider having to take a hold for 2 to 3 strides.
Mr Oatham also used the back on film to show the outward movement from DRAGONKEEPER.
Miss Smyth told the Committee that when she angled her mount out she thought she was clear.
Mr Tiley said Miss Smyth was looking for clear running and the incident was minimal.
Submissions for Penalty:
Mr Neal produced Miss Smyth record which showed one previous breach under this Rule in the last 12 months. He said the level of carelessness was at the lower end of the scale and Miss Smyth had made an error of judgement. Mr Neal submitted a suspension at the low end would be appropriate.
Miss Smyth advised that she had upcoming engagements at Ellerslie on March 8, and sought a deferment to any proposed suspension.
Mr Tiley submitted Miss Smyth had a good record and believed the interference was minimal.
Miss Smyth confirmed that she rode only in the North Island.
Reasons for Penalty:
The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Miss Smyth admission of the breach, her good record in relation to this Rule and we assess the level of carelessness low end which resulted in a minimal check to SECRETS ONLY.
After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
