Facts:
An Information Instigating a Protest was lodged by Stipendiary Steward Mr B Jones against the 5th placing of DUCHESS DIEDRE in the Promag Handicap Trot on the grounds of breaking passing the 80 metres mark and failing to regain its gait when finishing 5th.
The Breaking Horse Regulations provide that any horse which breaks in the last 200 metres of the Race and continues in a break in excess of 50 metres shall be in breach of Rule 870(3).
Mr AG Herlihy the Trainer and Driver of DUCHESS DIEDRE was not present at the Hearing but he endorsed the Information with the words " I do not contest the Protest ".
Stipendiary Steward Mr NG McIntyre on behalf of Mr Jones demonstrated the incident by use of the Race films. He showed DUCHESS DIEDRE along the Passing Lane in the straight and breaking with a little over 80 metres from the finish and continuing in a break up to the finish.

Mr McIntyre submitted that DUCHESS DIEDRE was in breach of Rule 870(3) and the Breaking Horse Regulations and should be disqualified from the Race.
