As Mr Hills admitted the breach we find the charge proved.

Penalty:

We grant Mr Hills' request to seek a deferment to his suspension as per Rule 1106(2).

Accordingly, Mr Hills had his license to ride in races suspended for a period to commence after racing on 14 February and conclude after racing on 21 February 2015 (4 North Island days).

Facts:

Following the running of race 4, Bell Neuhauser Matthews Optometrists 1600, an Information was filed pursuant to Rule 638 (1)(d). The Informant, Mr Oatham, alleged that Mr Hills permitted his mount EMERALD LADY to shift outwards when not sufficiently clear of ENDEAN ROSE which was checked near the 500 metres.

Mr Hills acknowledged that he understood the nature of the charge, the Rule and confirmed his admission of the breach.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Williamson demonstrated on the video film that EMERALD LADY was racing in the trail near the 600 metres with ENDEAN ROSE racing in the 1 out 1 back position. He identified when Mr Hills angled his mount out he was only ¾ to 1 length clear of ENDEAN ROSE which resulted in that horse being checked. He added that ENDEAN ROSE was weakening at the point it was checked.

Mr Hills told the Committee that he shifted out ½ a stride too much.

Submissions for Penalty:

Mr Oatham produced Mr Hills’ record which showed 1 previous breach under this Rule in the last 12 months. He described this as a good record. He believed Mr Hills misjudged the distance he was clear which placed the rider of ENDEAN ROSE in an awkward position. Mr Oatham submitted a suspension of 4 days would be appropriate.

Mr Hills advised that he had upcoming engagements at Taranaki on 14 February, and sought a deferment to any proposed suspension.

In response to a question from the Committee, Mr Hills said he had no engagements for Christchurch on 20 February.

The Committee considers Mr Hills to be predominately a North Island rider.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented. We have adopted 5 riding days as the starting point in considering the term of suspension. The mitigating factors are Mr Hills’ admission of the breach, we assess the level of carelessness as low end and his very good record in relation to this Rule. It was clear on the films that Mr Hills made an error of judgement when angling his mount out when not sufficiently clear of ENDEAN ROSE.

After taking into account all the above factors we consider an appropriate penalty is a 4 day suspension.
