Charge:
Alledged breach of rule 638 (1) (d).
Facts:
Ms Morgan represented by Mr Bidlake admitted a breach of rule 638 (1) (d) in that as the rider of Ambitious Beauty she allowed her mount to shift in near the 1100 metres mark when not clear of Lajuca (K. Myers) which was taken into the line of Danced All Night (D. Turner).
Mr. Goodwin using the available films indicated the point at which Ms Morgan's mount came across and put pressure on the horses down on her inside. At least two horses were affected and it was only after riders down on her inside called that she relieved the pressure. Over a short period of time he believed she had moved from 4 off the rail to 3 off.
Ms Morgan informed the committee that she thought she was clear but did agree that she should have eased off before the jockeys down on her inside called. Mr Bidlake added that it was the horse's first race in a hood and she could be a bit fractious.
Submissions for Penalty:
Mr. Goodwin submitted that this was Ms Morgan's first charge under this rule. She has had,as of today,117 rides and gives the stewards no trouble. He asked for a term of suspension as he believed the incident could be classed in the mid range. The tightening caused by Ms Morgan's actions was relatively severe. At least 2 other horses were affected. Mr. Goodwin asked for a period of suspension of between 4 – 5 days.
Ms Morgan had little to add but asked for any period of suspension to begin after racing on Saturday 22 December as she had confirmed mounts that day.. She informed the Committee she was a North Island rider only

Ms Morgan in coming to our decision to impose a period of suspension for this breach we have taken into account your admittance of the breach and your very good record however your movement inwards did cause as the films clearly showed tightening to a number of horses on your inside. Danced All Night’s rider was placed in quite severe difficulties for a number of strides. Because of your actions we viewed the incident above the mid range and strongly believe that you erred in not taking action to ease your mount earlier.
