Facts:
Mr Neal alleged that in Race 7 (NZB Insurance Pearl Series Race) that near the 800m Mr Johnson permitted his mount JOLLY GIRL to shift inwards when not the required distance clear of BRONSTEEL (L Hemi) and RED MELODY (D Bradley) with both being tightened and checked.
Rule 638(1) (d) reads:
A rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Johnson acknowledged that he understood the charge, the rule and confirmed that he admitted the breach.
Mr Goodwin demonstrated the films and said that in the run to the 800m Mr Johnson and his mount had been racing 3-wide and then on the start of the bend he let his mount roll in a little which resulted in BRONSTEEL shifting down onto RED MELODY which was tightened and checked. Mr Goodwin said that it was clear that Mr Johnson was not sufficiently clear of the runners to his inside when he shifted.
Mr Smith, on behalf of Mr Johnson, said that the angle of the films did not show how much Mr Johnson had shifted but conceded that he had shifted in when not clear. He also said that a runner that was outside of Mr Johnson may also have shifted.
Submissions for Penalty:
Mr Neal said that it was an error on the part of Mr Johnson and that the inside runners had run out of room and lost their running. He added that Mr Johnson had had approximately 60 race rides and that this was his first charge of careless riding. He suggested that a term of suspension was the appropriate penalty.
Mr Smith said that he did not agree with apprentices being suspended and believed that they should be fined for careless riding. He said that in his opinion the carelessness on this occasion was at the very low-end and added that if a suspension was to be the penalty that it starts forthwith.
Reasons for Penalty:
The committee considered all relevant matters including the 5 days suspension starting point for careless riding. The committee was of the opinion that there were not any aggravating matters. The mitigating factors were that this was Mr Johnson’s first ever careless riding charge, that he admitted the breach and in the judgment of the committee the carelessness was towards the low-end of the scale.
