The protest was upheld and the amended placings were:

The Committee authorised the payment of stakes and dividends in accordance with its decision.

Facts:

Following the running of race 10, an Information was filed Instigating a Protest pursuant to Rule 642(1). The Informant, Ms D Johnson, Rider of SACRED CAGA, alleged that DAWON or its rider placed 3rd by the Judge interfered with the chances of SACRED CAGA placed 4th by the Judge.

The interference was alleged to have occurred in the final straight.

The Judge's placings were as follows:

1st No.  5   WELL CHOSEN
2nd No. 11 LA FAVORITA
3rd No.  8   DAWON
4th No. 10  SACRED CAGA

The official margin between 3rd and 4th was a long neck.

Rule 642(1) states: “If a placed horse or its rider causes interference within the meaning of this rule 642 to another placed horse, and the Judicial Committee is of the opinion that the horse so interfered with would have finished ahead of the first mentioned horse had such interference not occurred, they may place the first mentioned horse immediately after the horse interfered with”.

For the purposes of Rule 642 “interference” is defined as:

(i) a horse crossing another horse without being at least its own length and one other clear length in front of such other horse at the time of crossing;

(ii) a horse jostling with another horse, unless it is proved that such jostling was caused by the fault of some other horse or Rider or that the horse or Rider jostled with was partly at fault; or

(iii) a horse itself, or its Rider, in any way interfering with another horse or the Rider of another horse in a Race, unless it is proved that such interference was caused by the fault of some other horse or Rider or that the horse or Rider interfered with was partly at fault.

All connections present acknowledged they understood the Rule.

Submissions for Decision:

At the start of the hearing the Committee explained the procedure for the protest hearing.

Ms Johnson submitted that near the 300 metres DAWON shifted out into line of SACRED CAGA. She said that she had to “sit up” for a few strides and SACRED CAGA lost momentum which she believed cost her from winning the race. Ms Johnson added that she called out to Mr Yanagida a couple of times when he was shifting ground.

Using the back on film Mr Williams identified that DAWON shifted out when not sufficiently clear of SACRED CAGA. As a result, that runner’s line was taken which he said cost it at least 1 length.

Mr Wenn said that DARWON shifted outwards and in doing so “beat” SACRED CAGA to a position near the 300 metres.

Mr Yanagida said that he agreed with Mr Wenn's submissions.

Mr Williamson on behalf of the Stewards said that entering the final straight SACRED CAGA was 2 lengths in arrears of DAWON. He said near the 300 metres SACRED CAGA had improved its position to be half a length in arrears of DAWON. He said at that point DAWON shifted out and crowded SACRED CAGA which had to relinquish its position which cost it 1 length. He said that given the margin at the finish there was a reasonable chance that SACRED CAGA would have beaten DAWON if the interference had not occurred.

Reasons for Decision:

The Committee carefully considered all of the submissions and reviewed the video footage.

The Committee found that near the 300 metres Mr Yanagida angled DAWON out when only half a length in advance of SACRED CAGA. As a result, that runner was forced wider on the track and off its rightful running line. Mr Yanagida failed to take reasonable steps to avoid causing interference when his mount shifted out about 3 horse widths. As a consequence, SACRED CAGA’s momentum was hampered for several strides which we deemed cost it 1 and ½ lengths.

After the interference occurred it was clear that at the 200 metres SACRED CAGA was 2 lengths behind DAWON. However, SACRED CAGA continued to finish the race off strongly and had reduced the margin to a long neck on DAWON at the finish.

Having considered the degree of interference, the manner in which both horses finished the race off and the margin at the finish the Committee is of the opinion that SACRED CAGA would have beaten DAWON had such interference not occurred.
